our scope and performance. A California Bay Area City
had historically bad relations with a federal agency. The
environmental community was at odds with the Mayor and City
Council. When we were brought into the case, it was apparent that a
new relationship between the city, the federal agency and the
environmental community had to be forged and a new plan for
relief was needed. By working with this particular city to
change attitudes, not only was a plan developed, it was
endorsed by the environmental community and adopted by the
federal government representatives.
A Southwest industrial
corporation
was on the verge of having its
property included into "critical habitat" for an endangered
species. Inclusion could have threatened the corporation
itself,
the jobs of thousands of employees and the economy of cities and
communities throughout the region. By guiding the
corporation through the process at the Department of Interior,
we were able to avoid application of the most onerous provisions
of the designation and provide a option for future operations
that would allow the company to work productively within the
restrictions of the law.
A Washington D.C. organization's
members were concerned that the implications of a Supreme Court
decision could put their national membership into chaos.
Carried out to its logical extreme, nationwide permitting
implied by the Supreme Court's direction could endanger the
financial well being of millions of Americans. By working with the Environmental Protection Agency we were
able to direct the agency to an analysis that removed the
negative impacts.
A Northwest Energy company
had a major gas-fired electric generator suffer catastrophic
failure. In conjunction with the manufacturer, repair of
the generator led the company to install new energy efficient
parts. This triggered new source review and threatened the
company with fines equaling hundreds of thousands of dollars per
month. When brought into the case, we contacted members of
Congress, agency heads and developed a team to address the
issue. Ultimately, a successful conclusion was negotiated
within two
weeks and was accomplished six months before the
Administration's new source review policy.
A Washington D.C. law firm
found it was conflicted out of work
for a client based on trivial, yet fatal, internal conflicts.
By working with the lawyers involved in the case, the
clients were provided with expert advice at an
efficient rate and returned to their law firm at the conclusion
of the matter.
